六,签署《谅解备忘录》
翌日(10月21日)黄纪作就跟首席部长签署《谅解备忘录》。

砂拉越首席部长与北加里曼丹人民军主任兼政委
黄纪作签署之《谅解备忘录》
1973年10月10日黄纪作在一封致首长的私人函件中,表示为了“恢复本州和平及终止战争,以便进行建设与发展”,他及他同僚愿意放下武器。该函於1973年10月13日收到。在黄氏请求下,首长於1973年10月19日,20日及23日,在成邦江政府馆跟黄氏举行会议。在
这项会议中,黄纪作提议在下述考虑下,他所指挥的北加人民军各单位愿意放下武器,重返社会为人民服务:
第一部分
(一) 北加人民军队员的马来西亚公民地位受到保证,北加人民军印尼国籍队员,在申请时给予马来西亚公民权。
首长解释在发给公民权方面涉及三类人士,第一类为那些人士他们是马来西亚公民。第二类为那些他们要想成为马来西亚公民之印尼国籍人。第三类(如有)由其他外国人士组成。至于那些真诚为马来西亚公民,首长保证他们将在马来西亚宪法下享有公民权利。至于第二类人士,根据黄氏估计大约20人,首长解释根据马来西亚与印度尼西亚两国政府协议规定,应该把这些人遣送回国。可是首长保证,由于情况改变,将把他们的马来西亚公民权申请,将在适当宪法条文下加以考虑。首长进一步阐明,所有重返社会的人士,将各自受到像看待任何其他公民,或其他居住在砂拉越外国人士同样的公平的对待。
(二) 北加人民军队员获有机会参与砂拉越联合政府的管理。
在这项会议中,已向黄氏解释他们在从事合法活动方面,享有像任何其他马来西亚公民同样的权利。黄纪作氏在说明他这项请求时称,砂拉越联合政府成员党在下届大选中可以考虑他的一两名人士作为候选人,至于这一点,首长答复称,候选人题名一事完全由有关成员党来决定。政府不会选择候选人。他的一两名人被提名为候选人的可能性,可以由有关政党来考虑。
(三) 在维护公安法令下拘留人士,在和平实现及人民利益下,应准他们重返社会。
首席部长解释维护公安法令授权有关当局可拘留任何人,如果他在砂拉越的活动威胁到国家安全。政府经常检讨拘留人士案情,实际上,其中许多人已获得释放。那些尚被拘留的人士,如果政府认为他们不再对国家安全有所威胁,一定会考虑释放他们。因此这完全需看拘留人本身去接受国内情况的改变,决定作为效忠与爱好和平的马来西亚公民而生活。
(四) 管制区将在恢复和平时撤销。
首长保证在州内和平全面恢复时,将顾到情况的改变而对撤销管制区问题作有利考虑。
(五) 在过去殖民地统治时被递解出境赴外国人士,在申请时答应给他们马来西亚公民权。
首长解释了有关这项问题的国际惯例,并保证在马来西亚跟中华人民共和国建立外交关系时,将检讨这问题。
(六) 政府考虑北加里曼丹共产党合法化首席部长解释在目前的情况下,联邦政府认为允许任何共产党组织注册,跟国家利益不符。首长进一步解释联邦政府不可能改变这项政策,而且群众也不会接受这项政策的改变。首长相信在本国宪法现有体系内,任何人能够在不损及本国安全情况下进一步贯彻人民的利益。
(七)他们组织内那些人员如要移居其他国家,应给他们必要的移居许可。
首长肯定这种请求将获得认可。
第二部分
设立一队出于自愿的先锋工作队,以协助政府为群众利益实现政府发展计划。
首长欢迎这项有建设性建议,并进一步解释称,目前州内已设有一个宗旨相似的这种团体。
双方同意北加共产党员拥有之所有武器弹药,应在双方管制下与监督下销毁。
上述凉解已记录在案,并於1973年10月20日在成邦江政府官邸(现已改名为和平馆)达成。

MEMORANDUM OF UNDERSTANDING
BETWEEN KETUA MENTRI SARAWAK
AND
MR.BONG KEE CHOK,DIRECTOR AND
POLITICAL COMMISSAR OF PARAKU
At the request of Mr. BONG KEE CHOK through his personal letter addressed to Ketua Menteri dated 10th of October, 1973, duly received on 13th of October, 1973, wherein he stated that he and his colleagues would agree to lay down arms "for the realization of peace in the State and cessation of war to carry out reconstruction and development", meetings were subsequently held between Ketua Menteri and Mr. BONG KEE CHOK in Rumah Kerjaan,Simanggang on the 19th, 20th and 21st day of October, 1973. At the aforesaid meeting, Mr. BONG KEE CHOK proposed that PARAKU Units under his command would lay down arms and rejoin society to serve the people, for the following considerations:
PART 1
(1) That the Malaysian citizenship status of PARAKU members be guaranteed, and further that PARAKU members who are Indonesian nationals be granted Malaysian citizenship upon application.
Ketua Menteri explained that there are three categories of persons involved in the issue of citizenship. The first category refers to those who are Malaysian citizens. In the second category are those who are Indonesian citizens. The third category comprises of other foreigners, if any. As for those who are bona fide Malaysian citizens, he assured that they would continue to enjoy the rights of citizenship under the Malaysian Constitution. With regard to the second category, who, according to Mr. BONG KEE CHOK, numbers about 20, Ketua Menteri further explained that under the provision of the Agreement between Malaysian and Indonesian Covernments, they are to be repatriated.
However, he assured that with the changed situation their cases would be taken up with the Indonesian Government with the view to allowing them to stay in SARAWAK, and that their application for Malaysian citizenship would be considered in the normal manner in accordance with the provisions of the Malaysian Constitution. As to the third category, applications for Malaysian citizenship would be considered under the appropriate provisions of the Constitution. Ketua Menteri further clarified that all those who returned to society would be treated equally and fairly as any other citizens or other foreigners residing in SARAWAK, as the case might be.
(2) That members of PARAKU would be given opportunities to participate in the management of the SARAWAK Coalition Government.
During the meeting, it was explained to him that they would enjoy the same rights as any other Malaysian citizens in the pursuit of legitimate political activities in the State.
Mr. BONG KEE CHOK clarified his request by stating that SARAWAK Coalition parties might, during the next General Elections, consider one or two of his men to stand as candidates. To this the Ketua Menteri replied that it would be entirely up to the respective component parties concerned to decide on the nomination of candidates. Candidates would not be chosen by the Government. The possibility for any one or two of his men to be nominated as a candidate could be considered by the parties concerned.
(3) That those who were detained under the PPSR should be released and be allowed to return to society as a result of realization of peace and to the interest of the people.
Ketua Menteri explain that the PPSR gives powers to the authority to detain any person whose activities in Sarawak threaten the security of the country. The Government has from time to time been reviewing the detainees' cases and many of them have in fact been released. Those who are still detained would certainly be considered for release provided that the Government is satisfied that they no longer constitute a threat to the security of the country. It will, therefore, be up to the detainees concerned to accept the changed circumstances in the country and to decide to live as loyal and peaceful Malaysian citizens.
(4) That the Controlled Area would be a abolished on restoration of peace.
Ketua Menteri assured that upon restoration of complete peace in the State, favourable consideration would be given to abolish the Controlled Area taking into consideration changing circumstances.
(5) That those persons who were deported to Foreign Countries during colonial rule be granted Malaysian citizenship upon application.
Ketua Menteri explained the international practice in regard to the issue and assured that this be looked into when diplomatic relation is established between MALAYSIA and the Peoples' Republic of CHINA.
(6) That consideration be given by Government to the legalization of NKCP.
Ketua Menteri explained under the present circumstances the Federal Government considered that it would not be in the interest of the country to permit the registration of any communist organization. Ketua Menteri further explained that it would not be possible for the Federal Government nor would it be acceptable to the masses to change such policy. Ketua Menteri believed that within the existing framework of our Constitution, it would be possible for anyone to further the people's interest without prejudicing the country's security.
(7) That those members of this organization who wish to migrate to other countries be
granted necessary permission to do so.
Ketua Menteri affirmed that such request would be granted.
PART II
That a Pioneer Working Brigade (out of one's own accord) be established to assist the Government in the implementation of its development projects for the benefit of the general masses.
Ketua Menteri welcomed such a constructive proposal and further explained that such a body, similar in objective, was already in existence in the State.
Both sides agree that all the arms and ammunitions now in the possession of NKCP members shall be destroyed under the control and supervision of both parties.
The above said understanding was recorded and reached at Rumah Kerjaan, Simanggang (hence-forth to be named "SRI AMAN") on the 20th day of October, 1973.

会谈之后,黄纪作留在成邦江跟政治部人员共同策划安排出人下山的问题。在纪作的指示下,10月25日蔡爱友带出总部单位的10位成员。这是当时谈判的第一批出人(不包括出去谈判的4位)。紧接着,蔡爱友和温尤远俩到邦督找沈泽清等5位同志,并到11月16日才把他们安排出去。
这是斯里阿曼行动在第一、二省的第一期计划宣告已顺利实现。
据说,政府当局认为当时黄纪作处在那样艰险困苦的环境,被迫作急促的“和谈”,未得北共中央其他领袖的同意与认可,实际上不能代表北加共产党,他只能代表个人,或者代表一个小单位。显然的,处在这样的地位,对黄纪作是很不利的。
斯里阿曼委员会曾开会决定:以《谅解备忘录》的条件与精神为基础,在第一省和拉士贡地区加以推行一切行动;不再跟整个党或一个组织进行正式的和谈,却以领袖或单位的个别来处理;加强实行军事行动和心理战的压力;通过黄纪晓把第一省北加人民游击队劝下山,最后迫使林和贵出来。在拉士贡地区,设法联络上洪楚廷,迫使他接受和谈,等等。
