根据历史记录，1963年7月初在伦敦签署此契约时，砂拉越总督府的上空还飘扬着英国国旗，即使到了7月22日那一天，砂拉越的军队，警察，外交，财政的权力都还在英国手中，到了9月16日，又直接转交给马来亚。
上述历史事实证明：
1，砂拉越当时没有独立，实质上是从原来的英国殖民地，跌入一个新殖民地陷阱；
2，砂拉越当时只是半自治政府；
3，MA63 无效，所以砂拉越有权要求独立。

MA63 的诉讼 是一个高度敏感的案件，如果被告在初步议题上无法搞定案件，可能会拖延相当长的一段时间。
相关律师有大量文件必须阅读，还要复印大量的文件提供给其他参与的律师和法庭。
原告有责任为法庭和被告的辩护律师以及自己的律师准备数量庞大的大部分文件。这些都需要很多成本。
我们需要为那些可能在深夜工作的律师或外省来古晋的律师们预订会议室和酒店房间。
我更关心是砂拉越以外或海外的律师，尤其是那位来自澳大利亚的律师，我希望他能回来帮助我们。我们需要他的专业知识和人脉，因为他可以咨询曾经在国际法院出庭的国际律师和教授。这可能会需要一笔费用 。

MA63 Suit is a highly sensitive case and can drag for quite sometime if Defendants are not able to knock the case out on preliminary issues.
There are many volumes of documents to read and to make copies for all lawyers involved and to court.
Plaintiffs are responsible to prepare most documents in which may come in huge volumes, for court and for defence counsels of the Defendants and for own lawyers. These can take lots of costs.
We need to book meeting rooms and hotel rooms for lawyers who may work late night or for lawyers outside Kuching.
I am more concerned about the lawyers from outside Sarawak or overseas, especially, one from Australia, whom I wish can come back to help us. We need his expertise and network because he has the contact to consult international lawyers and professors who ever appeared before the International Court of Justice. This may incur some costs
I hope we can come with some token fee for lawyers and their staff who are willing to come forward to assist us in the case.
Cost to court transcriber normally not much in normal cases, but in this case, could be another huge sum. This depends on the length of the transcript or notes recorded by court. Easily eat into a few hundred thousand ringgit.
We expect lawyers from UK and even from US and other European countries may wish to have a hand on the case or are interested to follow the case. I was told that lawyers in Sabah are also interested in our case
Its a huge and high mountain to climb.
